SeenBy Terms of Service

You must be at least 13 years old to use SeenBy, and old enough under the laws of your country to agree to these Terms. If you are under the age of majority where you live, you may use SeenBy only with the involvement of a parent or guardian. By using SeenBy you confirm you meet these requirements.

You sign in with your phone number and a one time code. You are responsible for keeping access to your phone and account secure, and for activity that happens under your account. Accounts may require an invite to join. Do not share your account or impersonate anyone.

SeenBy lets you capture photos of your friends and share them to their profiles, and lets your friends do the same for you. Photos ("moments") start visible to friends only ("Close"). Only the person shown in a moment (the "subject") can make it public, and the subject can remove or hide moments of themselves. Friendships are mutual.

Because SeenBy is about taking photos of other people, you agree that:

• You will only capture and share photos of people who are comfortable being photographed, and you will respect anyone who asks not to be.
• You will not capture or share photos in private settings or situations where people have a reasonable expectation of privacy.
• The subject of a moment controls whether it becomes public and can remove it. You will not try to work around these controls.

You keep ownership of the photos and other content you create on SeenBy. To operate the Service, you grant SeenBy a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for example, resize images), and display your content to the users the visibility settings allow, and as needed to run and improve the Service. This license ends when your content or account is deleted, except for content others have already saved and limited copies kept as required by law.

You also acknowledge that a person shown in a moment has the controls described above over that moment.

You agree not to:

• Post content that is illegal, hateful, harassing, threatening, or that violates someone's privacy or rights.
• Post sexual content involving minors, or any explicit or pornographic content. Uploaded images are screened, and explicit images are removed automatically.
• Harass, bully, stalk, or impersonate others.
• Post content you do not have the right to share, or that infringes intellectual property.
• Attempt to break, overload, reverse engineer, or gain unauthorized access to the Service.
• Use the Service to collect others' information, or use bots or automated scraping.
• Use SeenBy for advertising, spam, or commercial solicitation without our permission.

We may review, remove, or restrict content and may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk or legal exposure. Images detected as explicit are removed automatically. We are not obligated to store or return removed content.

SeenBy relies on third-party services, including Google Firebase and Google Cloud, and 019sms for text messages. Your use of SeenBy may also be subject to Apple's App Store terms. We are not responsible for third-party services, and their availability is not guaranteed.

You can stop using SeenBy and delete your account at any time from within the app. We may suspend or end your access if you violate these Terms or if we stop offering the Service. Sections that by their nature should survive termination (such as content licenses already granted, disclaimers, and limits of liability) will survive.

SeenBy is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, availability, or that content is accurate or appropriate. We do not guarantee the Service will be uninterrupted, secure, or error free. You use SeenBy at your own risk.

To the fullest extent permitted by law, SeenBy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the past twelve months (if any) or fifty US dollars.

You agree to indemnify and hold SeenBy harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or the rights of others.

These Terms are governed by the laws of the State of Israel, without regard to conflict of law rules. You agree that the competent courts located in Israel will have exclusive jurisdiction over any dispute arising from these Terms or the Service, except where applicable law gives you the right to bring a claim elsewhere.

We may update these Terms. If we make material changes, we will update the effective date and, where appropriate, notify you in the app. Your continued use of SeenBy means you accept the updated Terms.
